Waste management gains new important laws.

In recent months, some changes in environmental legislation have begun to occur regarding the generation and management of waste. It is important for companies to stay updated and comply with current regulations. In Law No. 9,605, of February 12, 1998, known as the Environmental Crimes Law, it is possible to identify that the technical responsible and the legal responsible for the waste generated and managed by an organization are civilly and criminally liable. First Law Regulation of the National Solid Waste Policy - Decree No. 10,936 of January 12, 2022 - General aspects. Decree No. 10,936 of January 12, 2022 brought important points for the advancement of waste management in Brazil, such as the energy recovery of hazardous waste, the opportunity to regularize cooperatives, among others. Second Law National Solid Waste Plan - Decree 11,043 of April 13, 2022. On April 13, 2022, the Federal Government published Decree No. 11,043, thus approving the National Solid Waste Plan, Planares. The National Solid Waste Plan is a technical development of the National Solid Waste Policy, working on all planning phases involving diagnosis, prognosis, and propositions. Third Law Reverse Logistics Law for Glass Packaging - Decree No. 11,300 of December 21, 2022. Through Decree No. 11,300, of December 21, 2022, the reverse logistics system for glass packaging was established in Brazil, with the main objective of encouraging the return of discarded glass packaging by citizens to the production cycle, which consequently generates jobs, preserves natural resources, and avoids improper disposal. Fourth Law Decree No. 11,413 of February 13, 2023, published in the Official Gazette. The decree repeals Decree No. 11,044, of April 13, 2022. Thus, the decree provides that manufacturers, importers, distributors, and retailers of products or packaging subject to reverse logistics that invest in structuring projects for the recovery of recyclable materials may request the issuance of CERE from the managing entity, meeting the following requirements: Having more than 50% of their overall packaging recovery target achieved through partnerships, with a minimum duration of 12 months, with: a) individual waste pickers; b) cooperatives and associations of waste pickers; c) entities whose waste origin is proven to be from waste pickers.
